Businesses in some of the highest energy-con¬suming and biggest carbon-emitting industries are behind many of these innovations. In the auto industry, Rolls-Royce, for instance, filed 425 patent applications in 2008, a record number for the company, which invested £885 million in re¬search and development that year, "a significant proportion" of which was aimed at reducing the environmental impact of its products. The global aviation industry, meanwhile, has agreed to cut its net carbon emissions to half of 2005 levels by 2050. The airline industry, if left unchecked, is forecast to account for up to 20 percent of all C02 emissions by 2050.

One of the major aircraft producers, Airbus, is de¬veloping new technologies to help bring this about, and protects its IP through patents. More than 380 patents have been filed in relation to technology developed for its double-decker A380 jet. "Significant breakthrough innovations have been achieved in aerodynamics, cabin de¬sign, engine integration, flight controls, aircraft systems, manufacturing techniques and the ex¬tensive use of advanced lightweight composite materials," the company says.

"These intellectual property rights secure Airbus' innovations and form a solid basis for maintaining Airbus' lead in new technological developments." One of the patents relates to a new joining process for mak¬ing a carbon fiber composite wing-box for com¬mercial aircraft. About a quarter of the A380 is made from composites, leading to a weight sav¬ing over traditional construction of 15 metric tons that significantly reduces fuel consumption.

L'Oréal, parce que je le vaux bien

The famous I'Oréal slogan "Because you're worth it," registered at the USPTO in 1976, has evolved with the company's cus¬tomers over the years. "Parce que je le vaux bien" and its English translation "Because I'm worth it" became popular in the late 1990s. In 2004, I'Oréal advertising started targeting the ever-growing cosmetics market for men with "Because you're worth it too." Then in 2009, their advertising started using "Because we're worth it" and for kids "Because we're worth it too." The shift to "we" followed a psychology-based study of I'Oréal's consumer base. "We" apparently creates stronger consumer in¬volvement in I'Oréal's philosophy and lifestyle and provides more perceived consumer satisfaction with I'Oréal products.

As I'Oréal celebrated its 100th anniversary in 2009, it continued to re-create itself, making ever stronger trademarks. A simple Madrid system database search yields 1,892 international trademark registrations for I'Oréal. The company also seeks to re¬main at the cutting edge of the cosmetics and beauty industry through research and development. It is reportedly the top nanotechnology patent-holder in the U.S.

Este cunoscut faptul ca in majoritatea cazurilor firmele cu un management performant pregatesc foarte bine lansarea noilor afaceri pe piata in cele mai mici detalii. Pentru a-si proteja investitiile facute in cercetare, infrastructura, personal, surse de finantare, marketing managerii acorda o atentie deosebita protectiei proprietatii industriale-intelectuale si anume brevetului sau brevetelor de inventie care stau la baza afacerii , marcii sau marcilor care vor identifica produsele sau serviciile ce urmeaza a fi lansate pe piata, designul produselor sau designul ambietal in care se va promova activitatea, programele de calculator utilizate, know-how-ul ,etc.

Un punct foarte important in strategia afacerii il reprezinta protectia marcilor. Sub acest aspect legea 84/1998 privind marcile si indicatiile geografice prevedea in cadrul procedurilor de inregistrare a marcilor examinarea de fond a acestora in care marcile similare sau identice cu o marca anterioara erau refuzate la inregistrare printr-un Aviz de refuz provizoriu la care solicitantul trebuia sa-si prezinte punctul de vedere.

Desigur acesta reprezenta un filtru al Oficiului de Stat pentru Inventii si Marci impotriva incalcarii unor drepturi anterioare asupra marcilor deja inregistrate. Aceasta procedura insa prezenta si dezavantaje ca de exemplu intarziarea excesiva a procedurilor, emiterea unor refuzuri uneori nejustificate si abuzive, oprirea de la inregistrare a unor cereri de marca pe baza unor marci inregistrate in scop de blocaj ,etc.

Din aceste motive. Oficiile europene au adoptat solutia examinarii marcilor doar in ceea ce priveste motivele absolute de interes public ca : descriptivitatea, moralitatea, interzicerea inregistrarii insemnelor de stat,etc lasand la latitudinea titularului de drepturi aterioare sa depuna opozitie in cadrul procedurii de opozitie dupa publicarea cererii de marca in cazul in care acesta se considera lezat in drepturile sale.

Aceasta solutie a fost adoptata si in legea noastra 84/1998 republicata care a intrat in vigoare incepand cu 10.05.2010 .In acest context devine foarte importanta supravegherea publicarii cererilor de inregistrare a marcilor in vederea formularii de opozitie prin care sa blocam inregistrarea unor marci si patrunderea acestora pe piata daca acestea incalca drepturi anterioare ale titularilor.

Aceasta masura are avantajul de a evita proceduri judiciare ulterioare necesare anularii acestor marci proceduri care sunt putin mai costisitoare mai ales daca aceste marci sunt comunitare sau internationale.Desigur ca in eventualitatea in care nu am uzat de aceasta posibilitate a opozitiei raman valabile si eficiente procedurile judiciare civile si penale conform legislatiei in materie.

Since 01.05.2009 is reduced by 40% the cost of the Community trademark registration. The registration fee for a community trademark will be reduced from 1600 Euro to 900 Euro for a mark up to 3 classes. In same time during the procedure registration shall be reduced by up to 50% so that a community trademark can be registered within 8-9 months.

This measure is designed to increase the company access to the community trademark system enhancing access to the European market of suppliers of products and services.
